the birth notarization is the act carried out by the notary public institute to notarize the legal facts of birth (including profiles of parents) within chinese territories in accordance with the application of the parties concerned (or the guardians).
the birth notarization can be divided into direct certification (with notarial certificate indicating birth date, birth place and biological parents of the parties concerned) and indirect certification (conformity between photocopy and original birth certificate provided by the parties concerned). different countries or departments may have different requirements. therefore, it is suggested that you should learn of detailed requirements from the embassy (consulate) deployed by the destination country in china or the department requesting you to provide the notarial certificate prior to handling birth notarization.
special notes:
★ the following list of materials is for reference only as specific materials may be required based on your case and requirements of notaries public.
★ the provision of certifying materials shall be originals and corresponding number of photocopies, unless otherwise specified. the photocopies shall be complete and clear and in conformity with the original (as for id card, the front and the reverse side shall both be copied).
the following materials are required for handling birth notarization:
i. identity materials of the applicant
① chinese mainland citizens shall provide id card and household register; applicants who are abroad shall submit photocopy of passport;
② foreigners shall provide passport;
③ residents of taiwan, china shall provide mainland travel permit for taiwan residents and id card;
④ residents of hong kong and macao, china shall provide mainland travel permit for hong kong and macao residents and id card;
ii. materials to prove birth-related facts, such as:
① birth certificate issued by a hospital;
② bound copy of household registration record issued by the public security organ;
③ birth certificate issued by the party concerned or the parents' archive administration department or the sub-district office (the people's government of the township or town) in the household register place, indicating the name, id card number, gender, birth date, birth place (down to city or county) of the applicant, the names and id card numbers of the parents (specify if the parents have died);
iii. identity materials of the parents; provide death certificate if one or both parents have died;
iv. certificate of marriage of the parents; where the parents have divorced, provide (1) the certificate of divorce and the divorce agreement (affixed with official seal) issued by the marriage registration office or (2) the civil mediation paper issued by the court or (3) the civil judgment paper issued by the court (the certificate of judgment effect shall also be provided if the case is settled during first instance trial).
v. photos: the required number of photos shall be the number of notarial certificates 1, and the photos shall be recently-taken 2-inch bareheaded color id photos of the same version;
vi. the power of attorney and the id card of the attorney shall be provided if an attorney is entrusted to make the application.
vii. other certifying materials deemed necessary by the notary public office.
